WARRANTY POLICY

Rapidfix Industrial (Asia) Ltd. (“Rapidfix”) manufactures the SMART-O oil drain plug (the “Product”). Do not use the Product until you have read the terms of this Limited Product Warranty (this “Warranty”). If you use the Product, you are agreeing to be bound by the terms of this Warranty. If you do not agree to the terms of this Warranty, do not use the Product and return the Product in its new condition to Rapidfix or its authorized distributor where you purchased it for a refund.


WARRANTY

Rapidfix warrants the Product against defects in material and workmanship when used normally in accordance with Rapidfix’s published requirements for a period of 1 (one) year from the date of original retail purchase by the original end-user purchaser (the “Warranty Period”).
Rapidfix’s published requirements include, without limitation, information contained in technical specifications, installation instructions, user manuals and service communications.


WARRANTY CLAIMS

If during the Warranty Period you submit a valid written claim to Rapidfix or its authorized distributor under this Warranty and Rapidfix determines that your Product is eligible for warranty service under this Warranty, Rapidfix will, at its option and sole discretion, (i) repair your Product, or (ii) replace your defective Product with a new Product or a remanufactured Product that is at least functionally equivalent to a new Product, or (iii) exchange your defective Product for a refund of your purchase price.
This will be Rapidfix’s sole liability and your exclusive remedy.


Please contact the Rapidfix authorized distributor where you purchased the Product or please contact Rapidfix using the contact information provided below in this Warranty.
The Rapidfix authorized distributor or a representative of Rapidfix will determine whether your Product is eligible for warranty service under this Warrant and, if it does, will inform you how Rapidfix will provide it.


Before receiving any warranty service, you must furnish your Product to Rapidfix or its authorized distributor for inspection, furnish proof of purchase to Rapidfix or its authorized distributor, respond to questions and provide documentation designed to assist with determining whether there is a defect and other potential issues, and follow Rapidfix’s procedures for obtaining warranty service.
In addition, if requested by Rapidfix or its authorized representative, you must allow for inspection of your vehicle, including the oil pan and engine.
Other documentation that Rapidfix or its authorized distributor may require from you in connection with your claim may include (without limitation): complete data for the applicable vehicle (including, make, model, year, engine/cylinder/displacement, engine VIN number, vehicle mileage reading at time of service, vehicle mileage when Product failed, vehicle registration papers), signed owners’ statement, signed mechanics' and service managers' statement, photos of oil pan and oil pan threads, photos of defective parts, invoices and repair orders.


You will be responsible for shipping and handling charges if the Product is required to be shipped to Rapidfix or its authorized distributor.
If you seek service in a country that is not the original country of purchase, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges.


NO OTHER WARRANTY

No Rapidfix distributor, reseller, employee, agent, or representative is authorized to make any modification, extension, or addition to this Warranty.


WHAT IS NOT COVERED BY THIS WARRANTY?

This Warranty does not apply to and is void with respect to:
(a) any product not manufactured by Rapidfix, even if packaged or sold with the Product; (b) Product not purchased from Rapidfix or its authorized distributor; (c) cosmetic damage or defect, including, without limitation, scratches; (d) damage or defect caused by use of the Product with another product not authorized by Rapidfix; (e) damage or defect caused by accident, abuse, mishandling, neglect, misuse, improper operation, improper storage, improper maintenance, improper installation, or improper service; (f) damage or defect caused by use or installation of the Product not in strict conformance with Rapidfix’s published requirements; (g) damage or defect caused by installation or service performed by anyone who is not an authorized service provider of the Product; (h) Product that has been modified without the prior written permission of Rapidfix; (i) damage or defect caused by or resulting from normal wear and tear or otherwise due to the normal aging of the Product; (j) Product that has been stripped or has its heads rounded off; or (k) damage or defect caused by fire, natural causes (including, without limitation, earthquake, rain, flood, wind and lightning), vandalism, acts of war or terrorism, or other external cause.

This Warranty does not apply to any service or conduct provided by any installer of the Product, including, without limitation, any installation error. Neither Rapidfix nor its distributor will be responsible or liable for the conduct of the installer of the Product.

It is the sole responsibility of the installer of the Product to ensure that the correct Product is used, and that in all cases the thread pitch, flange and diameter are matched with the drain plug that has been removed. This information can be obtained using the Smart Gauge to check thread pitch, diameter, length, and flange diameter. It is the installer’s sole responsibility to also verify that the Product has been torqued to specification and that it is checked after installation for leaks before the vehicle is permitted for operation.

This Warranty does not apply to any part of the vehicle to which the Product may be used, including the oil pan or the engine.

Damages caused by any of the following reasons are not covered by this Warranty: user of the Product (vehicle owner, mechanics, vehicle service personnel, customer, buyer) not changing oil in the engine within the prescribed ntervals for oil change; the oil pan having been in a damaged or in a worn or otherwise unfit condition prior to installation of the Product; an installer’s failure to tighten or over-tighten of the Product; an installer using a non-fitting Product; an installer not using torque adjustable tools to ensure recommended torque for the Product; a Product falling out for whatever reason during driving after installation; oil leaks after installation of incorrectly-fitting Product.


WARRANTY LIMITATIONS

THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED.

RAPIDFIX DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING (WITHOUT LIMITATION) THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS.
TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED, RAPIDFIX LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT RAPIDFIX’S OPTION, THE REPAIR OR REPLACEMENT SERVICE DESCRIBED IN THIS WARRANTY.


LIMITATION OF LIABILITY

RAPIDFIX IS NOT RESPONSIBLE FOR COMPENSATORY, DIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, BREACH OF CONTRACT, TORT, OR UNDER ANY OTHER LEGAL OR EQUITABLE THEORY, INCLUDING (WITHOUT LIMITATION): LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED, INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY.

c IF REQUIRED BY APPLICABLE LAW, THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS.



ADDITIONAL TERMS

If any term in this Warranty is held to be illegal or unenforceable, the legality or enforceability of the remaining terms of this Warranty will not be affected or impaired. This Warranty is governed by and construed under the laws of the country in which the Product purchase took place. This Warranty supersedes any and all other agreements, promises, representations or warranties, either oral or in writing, between you and Rapidfix with respect to any warranty applicable to the Product. No term or condition set forth in this Warranty may be modified or amended unless by a written instrument provided by Rapidfix.
